TERMS OF SALE

 

AUCTION PROCEDURE: This is a no minimum, no reserve, sold as is, online only/One All/Extend All Auction. Lots will begin closing October 16th at 12:00pm PDT, pre-bidding is currently underway.

 REGISTRATION: Registration is required prior to bidding and is a three or four step process, depending on if you have an account or not.  On yarbro.com-Fall Real Estate Auction Page, please download and read the Washington State Law of Real Estate Agency if you are successful bidder, as per Washington State Law, buyer will be required to initial the front page it has been read.  If you do not have an account on yarbro.com, please click Create Account on top right of page. If you have an account with us, you can jump to this next step. Please go to the auction webpage and register for auction and accept the terms. Lastly, buyers are required to provide verification of funds (see Proof of Funds below).  For any questions, please contact the auction company at [email protected] or call our office at 509.765.6869. Buyers are encouraged to pre-register no later than October 15th at 1pm and will be required to provide proof of funds, as stated below, prior to being approved for bidding. Upon successful bid and execution of purchase contract by 12 pm, Thursday, October 17th, 2024.  Wire instructions will be provided to purchaser(s). Seller will not consider an offer with contingencies (e.g. financing, inspection, etc.) Must use Auctioneer's or Seller's purchase and sale agreement. Additional informational documents are included with the listing.


SUCCESSFUL BIDDER(S):  Deposit Funds/Earnest Money are to be deposited with closing agent at title by Friday, October 18th, 2024. Earnest Money will be a 10% of bid price with a minimum of $10,000. 


FINAL CONTRACT PRICE: A 10% (ten percent) Buyer’s Premium will be added to the high bid to establish the Final Contract Price on Lots $100,000 or less & 5% on Lots $100,001 & greater. The bidder with the high bid will be required to sign and execute a Washington Real Estate Sale Contract/Purchase & Sale Agreement at the Final Contract Price. Bidders will need to confirm their bids and wire Deposit Funds/Earnest Money by Friday, October 18th, 2024, by 1:20pm (PDT).  In the event financing appraisal does not meet contract price, entire balance is owed at closing. Buyer agrees to pay contract price regardless of appraised value.  


BUYER REPRESENTATION:  Listing brokerage & Chuck Yarbro Auctioneers, Inc. represents the Seller.  Commission agreement is between Seller, Broker, & Auctioneer. Buyer's broker must physically visit the Property with Buyer & Buyer's broker must register as an agent of the buyer with Auctioneer to be eligible for offered compensation. 


DEPOSIT: The non-refundable deposit will be wired to the Title Company. Balance of the Final Contract Price due by wire transfer within 35 days from the date of the acceptance of the offer. Deposit funds are non-refundable, upon Seller’s acceptance of Purchase and Sale Contract.

Mutual acceptance of Purchase and Sale Contracts to be executed by Thursday, October 17th, 2024, by 12pm (PST).  

Property is being sold "As-Is" with No Contingencies; your bidding is not contingent upon financing or any further inspections.


MAPS: Maps, depicted boundaries, and stated acres are approximates based on Chelan & Ferry County Assessors’ public parcel data, current legal descriptions, and/or aerial mapping software and are not provided as survey products.


SURVEY: No survey.  Purchaser may survey after payment and possession.  


CLOSING/POSSESSION: Purchaser will wire balance with cash at closing. Real Estate Closing shall occur on or before November 20th, 2024, with possession at closing.    


TITLE/TRANSFER: Standard Title Insurance and escrow closing fees apply. Title insurance will be provided by the seller, on a standard title policy, insuring the title on such property to be statutory warranty deed, subject to all matters of record, except for liens that Seller will clear at Closing. A copy of the preliminary title report will be provided prior to close of escrow. Property taxes will be pro-rated as the date of closing.   WA Excise Tax to be paid by Seller.


EASEMENTS: Sale of property is subject to all easements, restrictions, roadways, and rights-of-way of record.

The property is being sold on an 'AS IS, WHERE IS' basis, with no warranty or representation, expressed, written or implied. Seller and listing brokerage reserve the right to remove any property from the auction or modify the terms in any manner. Each potential bidder is responsible for conducting his/her own independent inspections, investigations, inquiries, and due diligence concerning the property. The information presented on webpage is believed to be accurate but is subject to verification by all parties.

Remaining Terms
A. All property are sold AS IS, WHERE IS with all faults and without warranty expressed or implied. Chuck Yarbro Auctioneers, Inc is not responsible for any missing or incorrect listing information. We have attempted to provide accurate descriptions. However, it is the bidder's responsibility to conduct any inspections to determine the condition and feasibility of the bidder’s intended use. Descriptions that are provided by the auction company are provided in good faith and are matters of opinion. It is automatically acknowledged by registering that you have either personally inspected the items being sold, hired an agent to inspect the items being sold, or you have waived your right to inspect the items being sold. By placing a bid, this creates a contractual agreement to purchase the items being sold at the high bid price plus Buyers Premium and any additional fees.

B. The Auction Company and/or sellers are not responsible for any accidents in relation auction property. 

C. Chuck Yarbro Auctioneers, Inc has full discretion to modify the date and time, order, and details of the auction for any reason or for no reason at all, including but not limited to technical issues, emergencies, and convenience of Chuck Yarbro Auctioneers, Inc or the Seller.

D. In the event there are technical difficulties related to the server, software or any other online auction-related technologies, Chuck Yarbro Auctioneers, Inc and the Seller reserves the right to extend bidding, continue the bidding, or close the bidding. Neither the company (Bidpath) providing the software nor Chuck Yarbro Auctioneers, Inc, or the Seller shall be held responsible for a missed bid or the failure of the software to function properly for any reason. Email notifications may be sent to registered bidders with updated information as deemed necessary.

E. All announcements on auction day will take precedence over any and all printed material.

F. I grant Chuck Yarbro Auctioneers, Inc the right and permission to use video or still imagery of me or in which I may be included with others, to take, use, reuse, publish, and republish the same in whole or part.

G. Chuck Yarbro Auctioneers, Inc reserves the right to revise The Terms and Conditions at any time.

H. The bidder agrees to pay reasonable attorney fees incurred by Auctioneer, should the Auctioneer require the services of an attorney to enforce bidding terms. Any such legal action will take place in Grant County, WA.
